Terms and Conditions (English Law)

1. Definitions.

Force Majeure: Refers to any event or circumstance beyond the reasonable control of Sea Gypsy Sailing or the client, including but not limited to strikes, lockouts, riots, invasion, war, fire, explosion, sabotage, civil unrest, demonstrations, blockade, terrorism, extreme weather, government regulation, or other Acts of God.

Client: Any individual, paying or invited, aboard the vessel, excluding the skipper.

Skipper: The individual appointed by Sea Gypsy Sailing to be responsible for the operation and navigation of the vessel.

2. Bookings and Confirmation​.

2.1 All bookings are provisional until reviewed and confirmed by Sea Gypsy Sailing.

2.2 Confirmation will be issued via email. The booking becomes binding only upon receipt of this email.

2.3 In the event that a booking cannot be confirmed, a full refund will be issued.

2.4 Sea Gypsy Sailing reserves the right to cancel or decline any booking at its absolute discretion.

3. Payment and Cancellations.

3.1 Full payment is required at the time of booking.

3.2 Cancellations by the client:

      28 days or more before departure: Full refund minus a 3% booking and Administration fee.

      15 to 27 days before departure date: 50% Refund.

      14 days before or less (including the departure date): No Refund.

3.3 All cancellations must be submitted in writing by email.

3.4 Should Sea Gypsy Sailing or the skipper cancel due to Force Majeure, adverse weather. vessel issues or any other reason, liability is limited to a full refund or rebooking of the trip. No responsibility is accepted for additional expenses incurred by the client.

3.5 Clients are strongly advised to obtain adequate travel insurance to include sailing.

4. Delays.

4.1 Clients must notify Sea Gypsy Sailing immediately in the event of delay.

4.2 While reasonable efforts will be made to accommodate late arrivals, departures may be constrained by tides, weather or trip requirements.

4.3 Failure to arrive on time may result in forfeiture of the trip without refund.

​5. Under 18s.

5.1 Persons under 18 years of age will only be accepted if accompanied by a parent or guardian.

6. Foreign Ports and Documentation.

6.1 Clients must ensure possession of a valid passport for cross channel trips.

6.2 Failure to provide valid documentation will result in denial of boarding without refund.

6.3 Clients are responsible for compliance with all Customs and Excise regulations.

7. Skipper's Authority.

7.1 The skipper's decisions are final at all times, both at sea and ashore in accordance with marine practice.

7.2 All clients must comply with instructions and orders from the skipper.

7.3 Should a client be disembarked at the nearest port by decision of the skipper, Sea Gypsy Sailing accepts no liability for any costs incurred by the client as a result.

8. Clients Duties and Behaviour.

8.1 Clients are expected to participate in all duties aboard including but not limited to, cooking, cleaning and routine maintenance.

8.2 A polite and professional manner is required at all times towards the skipper and fellow clients.

8.3 Sea Gypsy Sailing operates an inclusive policy and will not tolerate any abuse whether verbal or physical.

8.4 Disputes should be referred to the skipper promptly for resolution. Failing mutual agreement this contract shall be governed by English Law.

9. Insurance and Liability.

9.1 Sea Gypsy Sailing holds insurance for CAT 2 commercial use up to £5,000,000.

9.2 Clients are strongly advised to obtain personal travel insurance to cover illness, accident, late arrival or inability to complete the trip.

9.3 By booking, clients accept full responsibility for themselves and any injuries sustained while on board.

9.4 Sea Gypsy Sailing accepts no responsibility or liability for illness, injury or loss or damage to personal belongings except as required by law.

9.5 In the event of cancellation due to Force Majeure no liability is accepted beyond refund or rebooking.

10. Health and Safety.

10.1 Clients are responsible for ensuring they are physically and mentally fit for the trip, trips they have booked.

10.2 Severe seasickness or health issues may result in a client being disembarked at the nearest port at their own expense subject to the skippers decision.

10.3 Life jackets will be provided and must be worn at all times whilst on board in the external areas of the vessel.

10.4 The Skipper's decision regarding safety is final.

11. Governing Law.

11.1 These terms and conditions and any disputes arising shall be governed by and construed in accordance with the laws of England.
